Special Terms for Trainings

1.   The following Special Terms shall be applicable to all agreements, offers and supplies entered into or made by OMICRON in respect of training. In addition to these Special Terms the General Sales Conditions of OMICRON shall always be applicable. In order to become effective, any deviation must be explicitly approved by OMICRON.

2.   OMICRON differentiates between two types of training: The training catalogue of OMICRON contains general trainings held as open seminars for all who are interested. Individual trainings are held at the request of an individual customer and are designed to suit the customer’s specific needs.

3.   Terms for all trainings (general and individual trainings):

      3.1.   OMICRON reserves the right to cancel or to adapt trainings (date, lecturer etc.), as applicable and customers shall not derive any rights therefrom. Should such a case occur, the customers will be informed in due time. In case of a cancellation, all paid amounts shall be refunded.

      3.2.   The training documentation made available is intended for the customers personal use only. OMICRON (or its licensor) reserves all rights to the documents and all parts thereof, including the translation, the reprint and the reproduction. Therefore, third parties may not – for whatever purpose – reproduce or replicate, or process or distribute with the help of electronic systems any part of the training documents without OMICRON’s written permission. This obligation continues to apply after the end of the seminar. 

      3.3    With the application form it is possible to have OMICRON book the accommodation at the reduced firm rate in the conference hotel or in a hotel near the training center in which the seminars are held, as applicable. If this option is made use of, the information will be submitted to the respective hotel on a binding basis. OMICRON shall be informed of any changes without delay. The settlement of all costs relating to the accommodation shall be made directly between hotel and guest or the delegating company, as applicable. This provision shall also apply to any cancellation costs, e.g. in case of no-shows.

4.   Additional provisions for general trainings (open seminars):

      4.1.   The price for the seminar includes lunch, food and drinks during the breaks and seminar documents; other expenses such as accommodation costs, parking charges etc. shall, however, not be covered.

      4.2.   A cancellation or rebooking by the customer shall be made in writing. As places on the seminar cannot be filled at short notice, we reserve the right to charge 50% of the seminar costs if we receive a cancellation 28 to 14 days prior to the date of the seminar and 100% in case of a later cancellation.

5.   Additional provisions for individual trainings:

      5.1.   The content, location, duration of the training, size of the seminar group, proposals for the seminar date and the scope of the performance for customized trainings shall be coordinated with the customer according to its wishes. On this basis OMICRON shall prepare a customized written offer, which shall be subject to change and non-binding.

      5.2.   The date of performance shall be agreed depending on OMICRON’s anticipated capacity and shall be non-binding and subject to unforeseeable circumstances and obstacles.

      5.3.   The seminar services include the provision of training documents, exercises and other services which may be necessary and useful to achieve the objectives of the training.

      5.4.   Customers may cancel customized trainings free of charge until 90 days prior to the event. Until 30 days prior to the training date we will charge 25%, and until 15 days 50% of the order costs. In case of cancellations made less than 15 days prior to the date of the event, the customer will be charged 100% of the order value. The customer shall not be entitled to claim refund for parts of the services it did not use.

      5.5.   Until 40 days prior to the event, customers shall have the one-time right to agree with OMICRON on a postponement of the date free of charge. In the event of cancellations made less than 40 days prior to the date of the event, OMICRON will charge the principal any costs incurred in connection with the individual organization, e.g. cancellation of hotels in which the training should be held, flight or rebooking costs etc., as applicable.

      5.6.   The customer shall provide OMICRON with data, information and equipment, which enable OMICRON to provide its services successfully and completely.
